Your new employer can file an H-1 petition for you, BUT you are not eligible for an extension of H-1 status because you are not currently maintaining H-1 status. In order to resume H status, once company B's petition is approved, you would have to go to a US Consul outside the US, obtain an H-1 visa and then re-enter the US using that visa.

I have a question. I am on H1 and are planning to extend my H1 along with my wife H4. My question is, we both have EAD's and I never use EAD. My wife is looking for jobs on EAD. If she works on EAD, can she still able to extend H4 status?

As long as she does not work, and she has entered the country using her H4 (as against entering using Advance Parole), she is on H4. Once she uses her EAD, she is no longer on H4. Subsequent US entries will need to be on Advance Parole.

You can take time off -- like 4 weeks without any issue (I have done this), as long as the new company has filed to transfer your H1B petition.
I guess you should avoid going out of status -- where the old company has revoked your H1B when the new company hasn't even filed the H1B transfer petition. Other than this, taking time off between jobs should not be any problem at all, provided you stay within the country and, no travel outside the US. But if you do, you should consult your lawyer about its implications. Good luck with your new endeavors.

I am currently working as Programmer Analyst for a company who is currently doing the GC. I have been with them for about 7 years.
Starting next month I am going to use my H1 7th year.
I am pondering about a new offer Firmware Engg. My GC detaisl are below:
PD: 06/2003 -- EB3
Education: MS
I am planning to stay in H1B, if possible with the new employer. But thinking of doing PERM and see if I can port my earlier date during I-140 filing.

I am july 2nd filer , received by R.Williams at NSC and still dont have EAD so I took infopass appointment as my case status still shows pending. I did fingerprints about 2.5 months back. I was told in the infopass that my case is still pending so if i do another set of fingerprints, my case would come up to grab attention of the staff at NSC. So, they did fingerprinting again and lo, i saw 2 luds on the 765 yesterday and today , am I really going to get EAD soon or did the infopass uscis guys just fool me and take the fp just to pretend they did something on my case, anybody else faced this, pls respond.

They are not always up to date on their processing times.
Evidently.... I guess I can't rely on it too much for predicting approval of the other applications. I heard of a similar situation too, the receipt date is very close to mine and it got approved today.

I saw strange messg on my I-485 while checking the status what does this mean.
Review of the fingerprints taken relating to this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS has been completed. Processing of this case continues. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. We process cases in the order we receive them. One of my friends applied for his GC thru a consulting company which he does not work for...He used to work for the company but left that company before he decided to file with them...Since he has good relations with the company, they decided to file for him.
The company recently filed his I140 but they got a RFE on I140. INS wants to know why does the company want to hire him and why he left the company in the first place..does anyone in the forum has a similar experience to share...The RFE is actually for the conmpany but the owner wants my friend to write a letter and mail it to the lawyer. Any help is appreciated.
First, employer or his agent only reply to RFE, not your friend.
Second, it is a simple stright forward RFE, unless INS found some fishy thing (or doubting as it is a bonafide sponsership) as employee not working for sponser. May be they are trying to control future employee loop hole. Employer can write the reason why he left and why they want to hire him back. It is a strightforward easy question to answer.

All,
Per Aug 2008 Bulletin, my dates are current.
But My and My spouse's 485 is transferred to NBC sometime back (we never heard anything)
My daughters 485 is still at TSC.
Anyone know, whats gonna happen now?
I get a feeling that, our apps will be laying eggs while dates are current :mad:

Maybe USCIS would earn more income by telling the illegal immigrants to file EAD/I-485/Biometics every year etc.. Immigration attroneys would earn good money by replying to RFEs for 12 million immigrants. Getting this 12 million illegal immigrants legalized will surely improve the economy.

To the best of my knowledge, e-filed applications for EAD and AP renewals usually trigger biometrics appointments. If applications for EAD and AP renewals are filed the old-fashioned way, biometric appointments will probably not be required.
With respect to your second question, you must be physically present in the US to file tha application for Advance Parole.

I need to re-file my I-485 application which was rejected due to USCIS error (they could not find I-140).
Can anybody tell me what is the logic behind writing "DO NOT OPEN IN THE MAIL ROOM" on envelope while re-submitting I-485 appplication?
I will need to send to USCIS today. Please let me know ASAP.
