My EAD is going to expire in 3 months and I am filing for my renewal now. What can be done if you don't get the EAD renewal response before the expiry of the current one ?
I heard somewhere, that if you don't receive the renewal notice within 60 days, then you can approach the local USCIS office and get a temporary EAD card for 90 days.
Anybody knows more ?

In 2005 I (american citizen) applied for a I-130 petition for my husband who is an Indian citizen. (It was approved.) Then after that the case was placed under administrative review at the Mumbai embassy in India. It is still pending for over four years now. As of Sept. 2008 My husband recieved a letter stating the petition was sent to the USCIS here for review and possible revocation. We were told to contact them here for our case. They can not find anything on our case.
He is now in Canada on a student visa. Can I apply for a K-3 visa while he is in canada on a student visa? I was told he would need to go back to India for me to apply for a K-3 visa. USCIS agent told me to take the steps in applying for a K-3 visa for him.

I took an infopass appointment last october and my FBI name check status was pending. After seeing the USCIS memo on march4th that all namecheck pending for 180 days has been cleared by feb 28th 2009, i went again for an infopass appt last week. IO toldme that my namecheck is still pending.
So i contacted my senators office same day and sent all my info along with the USCIS memo. Next day senators office called me back and told me that they called USCIS and came to know that my name check has been cleared. Senators office told me that infopass information could be wrong or may not have been updated.
IS that a possibility ? any inputs ?

My nationality is Indian. Presently i am residing in USA . I have " Advance Payrole Document " . I am planning to travel in this February 2011 from " Atlanta -> Frankfurt -> India(Hyderabad) " and return is in May 2011 from " India(Hyderabad) -> Frankfurt -> Atlanta " in lufthansa airways.
So shall i go for this round trip with a valid " Advance Payrole Document " only ? or i need to have " Air Transit Visa ? If i need Air transit Visa could you please let me know how to apply and what documents i need to submit .
please help already buyed tickets from lufthansa website. non refundable ticket. before that one time i cancelled ticket. airport transit visa shall we apply by post/mail ? in person cant go because very far totally 30 hors drive that too with infant driving not possible . please help ?

you can enter the country even a day before your visa expires, but the main thing here is the i-94 stamp where the immigration officer puts the duration of your stay...it will be till your visa expiry date. so it is better for you to have an approval for the extension so that you can get to stay till the expiry of your visa. do premium processing or something, you still have time...

Hi, I am currently on my 5th year H-1B visa. I have an option to stay with the same firm and they will help me apply greencard. But I am also considering an opportunity in Bermuda for a 2-3 year program (with the same firm).
My question is if I come back to the US after 2 years, will I be able to apply H-1B visa again? Will it be a whole new H-1B petition/application process subject to the H-1B cap?
Or will it be just another H-1B renewal process following my previous two terms?
Do I need to wait for another two terms of H-1B to expire before starting the greencard process?
Can I ask my currently employer to apply for greencard concurrently while I am working outside the US?

I would like to file my PERM through a good immigration lawyer in bay area. Does anyone have any recommendation? Has anyone used Indu law firm?
Some of the big names like fragomen etc seem to handle mostly company cases and are too expensive for individual case filing.
Also how much is the charge typically for the whole GC process or PERM. I know it would vary depending on lawyers but i am looking to get some general idea on how much people on the Forum have spent filing their cases from GOOD lawyers.

You have to decide whether it is worth the hassle. If you are relying on this EAD to start working on it immediately, then it would make sense to bite the bullet and assume the monetary loss.
If you are not going to use it any time soon, then you should think about appealing and getting a 2 year EAD and save the extra money you will have to spend.

I have a request / concern / what ever you would say.
Please do not cirtize if you do not like the idea, just ignore and leave the thread.
There are so many people comming to IV for other experts guidance on different things mainly on H1B status, AC21 status, AP, FP, EAD and H4 to EAD, .....
Why don't you create a general guide lines or rules or do's and don't or QA's for each topic, so that each member or visitor who come to IV can atleast go through them before asking or posting quesitons.
You can create a survery for different kinds of questions people / members / visitors might ask or have fore each topic before creating the thread so that we can have a pool of questions and answers for each topic from experts or attorney answered. (you might say we have recordings from attorney Prashanti Reddy, but it would be good if we have some thing which can be referred easily i.e., typed.
These are just some of my thoughts, it can or cannot be implemented. It depeneds on IV admins/Gurus/Experts on this forum.
Gurus, please provide your thoughts.

They do random inspection on applications. Some people who have no work permit are being inspected if they are working illegally and some are found to be.....even if they do not accept pay or just saying they are volunteers.....

I-140 has been approved. Our priority date is in May 2008.
The current "priority dates" for EB-3 as per USCIS is April-2001. Based on this, When can we expect our "485" to be filed and our EAD to be approved ?
I have a law degree from India (12+3+3) and currently I am pursuing a paralegal program from an ABA approved university. I might loose my job oppurtunities if I don't have a work permit. Is there anyway that I can get a work permit with my pending GC application process, without hampering the GC process ? Can I get a work visa (or EAD) based on my education ?

With a priority date of May 2008 EB3-India, unless there are legislative changes (or another July 07 fiasco) you are expecting a wait of atleast 4-5 years before you can file your 485 and get an EAD. Perhaps longer, considering how EB3 is ~8 years backlogged.
Your best bet would be get H1-B sponsorship.

While filling the I-94 arrival record, My Friend did not give his last name at all . There was only two fields he filled 1. Given/First Name & 2. Date of Birth only.
So the I-94 record does not have his Family (Last) Name.
Is there any other center available so that he can give his last name for I-94 or he has to file the form I-102 (the disadvantage for filing the form is he has to send the original I-94 along with $320)

Once you change to AOS and invoke AC21 after 6 months, you can choose to do nothing or even be without a job. The only thing thats important is that the job offer should be available at the time of 485 adjucation.
