I travelled back from India on 04/26/09 via Detroit. All I was carrying was PP, AP and EAD.
There were absolutely no issues, wasn't asked a single question on entry.... looks like all

I lost the hope of GC after working 10 years in US because my GC is not approving.
Is it possible to file case against my employer and ask to return money that they deduct from me for GC and the % that they earned from me in last 8 years. I joined my employer for smooth GC process but even my I140 is not approved. My labor went to backlog. Once labor approved than I140 is pending for last 30 months. USCIS is trying to find out that my company is legitimate or not.
Do not argue how I know that I140 is pending because of company. Please let what is process to inform USCIS about my employer. My company files GC so that no one should leave the company. Employer gives hope about GC but I140 never approves. What all evidence I have to collect so that I can prove against my employer. Please suggest.

of golden opportunities of GC sponsorship etc to get people at low rates. Even lawyers
promise sun and the moon to sign you up but they hide the reality.
I know companies even lie that project is 6 months and renewable but once you join
and shift to the new place and then after 2 months they say the project is over. They
knew all along that the project is for 2 months but they wanted people, so they lie
that the project is long.
I know right in 2007, one friend of mine was negotiating a lower salary in return of GC sponsorship. But by 2007, the retrogression was far too apparent. Clearly he was totally ignorant. Even then he joined. Few months back another friend of mine was filing for

Thanks Roger for the reply. Mine was 3 years degree. So they mentioned that it is not equvilent to U.S. Bachelor degree. They did not have any issue with my experience which is more than 5 years.

1. check if ur H1 sal =Sal Received (considering 8k)
If sal received - 8K > H1 Sal , then its difficult for you to claim unless he has given you some hike
2 Does any of the pay checks mention any advance ?
3 If you have to return 8k, you can ask him to reduce the tax which u have paid which will be 30% So you might return 5.5K

Since there are lot of ppl here who have had EAD/AP for years ...
Do you know if USCIS lets you petition for renewal of EAD/AP only 4 months before expiry? Our legal assistant says that they can not apply for renewal until its 4 months to expiry. I was under the impression that we could apply six months in advance. Can someone post a USCIS link that provides a definitive answer?

I was in the same situation and was told by the SSN office person ( a very helpful guy) to re-apply and enter my address as of the SSN office address and he kept my cell number. He said he will call me as soon as the number arrives and then again when the actual card arrives. He called me on both occasions and I got my number in 2 days and the card in less than a month !
I was very grateful for the help and advice the SSN office person provided me at that time.

Guys, I was just laid off and have efiled i539 3 days after the termination date for a status change to F2. Now working on the application letter. Do you think I should mention the layoff in the letter?
If I do mention it:
Con: The layoff might quickly catch the eyes of the immigration officer and if he want to check my status, he could find out the 3 days OOS.
Pro: My previous job was well paid. By mentioning it, I give the reason that why I want to stay at home as F2 instead of keeping the well paid job.
I guess I will mention it in the letter to explain the whole situation and hope everything will be all right. Let me know if anybody disagrees asap, I will mail out the stuff with in next two days.

My PD is in Apr 2002, EB3. I filed for EAD renewal on Jun 23 2008. Got approval on Aug 13 2008. got EAD for 1 year in mail instead of 2 year.
I called USCIS they told me use EAD and file new I9 form with employer based on this 1 year EAD. Then re-file new I765 form with USCIS with cover letter explaining why I should get two year EAD; plus send orginal EAD back. if USCIS find any error on their side they will correct it and send new EAD cards.
I am scared to send orignal EAD back.. just in case employer ask for EAD card again!!

The last time i talked to iio, she said they are processing I485s received in Apr, 2007 and they will start mine in 2 or 3 months.(mine was received on july 24th and pd is eb3 oct 2003). she said, they will process the applications even if the pd is not current but only approve if the pd is current.
